New Jersey has an Extreme Risk Protective Order Act pursuant to N.J.S.A. 2C:58-23 through 2C:58-32. Under the act, an eligible petitioner who is concerned that an individual who has access to a firearm and poses a threat to themselves or others can file a request to have the firearms and related permits revoked. An eligible petitioner is a family or household member (spouse/partner, household member, child-in-common, current or former dating partner), or law enforcement officers in their official capacity. Law enforcement can assist concerned household or family members with filing these applications. An individual who has concerns, but whom is not an eligible petitioner, can report their concerns to law enforcement and request that law enforcement file an application. Filed applications for ERPOs are reviewed by a Judge. If granted, an ERPO temporarily prohibits a person from owning, purchasing, possessing, or receiving firearms and/or ammunition, or from securing or holding a firearms purchaser identification card, a permit to purchase a handgun pursuant to N.J.S.A. 2C:58-3, or a permit to carry a handgun pursuant to N.J.S.A. 2C:58-4. This temporary order can become final following a hearing by a Superior Court Judge.
